Introduction

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between Dream IT Constructions PTY LTD ("Company", "we", "us", "our") and you ("Client", "you", "your"). This Agreement establishes the general terms and conditions governing your engagement with our luxury home construction services, website, and any related products or services.

1. Acceptance of Terms

By engaging our services, requesting quotes, visiting our website, or entering into any agreement with Dream IT Constructions, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any provision of these terms, you should not use our services or website. Your continued use of our services constitutes acceptance of these terms.

2. Services Provided

Dream IT Constructions provides luxury residential construction services including custom home design, project management, construction, and related services as outlined in individual project agreements. Our services are tailored to meet each client's unique vision and requirements. Specific scope of work, timelines, and deliverables are detailed in separate project contracts and quotations.

All services are subject to site conditions, local council approvals, and compliance with Queensland building regulations and standards.

3. Project Agreements & Contracts

Engagement with Dream IT Constructions requires execution of a formal project agreement or contract. The terms of the specific project contract supersede these general terms where there is conflict. All project agreements must be signed by authorized representatives of both parties and include detailed specifications, timelines, pricing, and payment terms.

Any modifications to project scope, timeline, or pricing must be documented in writing and signed by both parties.

4. Payment Terms

Payment terms are specified in individual project contracts and quotations. Typically, payments are structured in stages aligned with project milestones. Failure to make payments as scheduled may result in suspension of work and potential project termination.

All invoices are due within the timeframe specified in the project agreement. Late payments may incur interest charges as permitted by law.

5. Intellectual Property

All designs, plans, drawings, specifications, and other intellectual property created by Dream IT Constructions remain the property of Dream IT Constructions unless otherwise agreed in writing. Clients receive a license to use these materials for their specific project. Unauthorized reproduction, distribution, or use of our designs or materials is prohibited without written consent.

6. Warranty & Guarantees

Dream IT Constructions provides a 10-year structural warranty on all completed projects as standard, covering structural defects in materials and workmanship. This warranty is subject to the terms and conditions outlined in the project agreement and applicable building legislation.

Warranty coverage does not include:

• Damage resulting from improper maintenance or use
• Damage from natural disasters, acts of God, or unforeseen circumstances
• Modifications made by third parties without our authorization
• Normal wear and tear or cosmetic issues

For warranty claims, clients must notify Dream IT Constructions in writing within 14 days of discovering the defect.

7. Project Timeline & Delays

Project timelines are estimates based on current conditions and are subject to change due to unforeseen circumstances including weather, supply chain delays, council approvals, or site conditions. Dream IT Constructions will communicate any significant delays to the client promptly.

Delays caused by client decisions, incomplete information, or failure to provide access to the site are the client's responsibility and may result in additional charges.

8. Client Responsibilities

Clients agree to:

• Provide accurate information and site access as required
• Obtain necessary council approvals and permits
• Maintain adequate insurance coverage for the project
• Comply with all applicable laws and regulations
• Make timely decisions regarding design and specifications
• Ensure payment of invoices according to agreed terms

9. Limitation of Liability

To the fullest extent permitted by law, Dream IT Constructions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of business opportunity, or business interruption, even if advised of the possibility of such damages. Our total liability is limited to the amount paid by the client under the project agreement.

10. Indemnification

Clients agree to indemnify and hold harmless Dream IT Constructions, its officers, employees, and agents from any claims, damages, losses, or costs arising from the client's breach of these terms, negligence, or violation of applicable laws.

11. Dispute Resolution

Any disputes arising from these terms or project agreements shall first be addressed through good faith negotiations between the parties. If disputes cannot be resolved through negotiation, they shall be settled through mediation or arbitration in accordance with Queensland law.

Both parties agree that arbitration shall be conducted in Queensland, Australia, and that Queensland law shall govern all disputes.

12. Termination

Dream IT Constructions may terminate a project agreement if:

• The client fails to make payments as scheduled
• The client breaches material terms of the agreement
• The client fails to provide necessary access or information
• Site conditions make completion impractical or unsafe

Upon termination, the client remains responsible for all work completed and expenses incurred to date.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland for any disputes arising from these terms or your use of our services.

14. Changes to These Terms

Dream IT Constructions reserves the right to modify these Terms at any time. Material changes will be communicated to clients at least 30 days in advance. Continued use of our services following notification of changes constitutes acceptance of the revised terms.

15. Entire Agreement

These Terms of Service, together with any project agreement or contract, constitute the entire agreement between Dream IT Constructions and the client regarding the subject matter and supersede all prior agreements, understandings, and negotiations.
